This Privacy Policy describes how Liftkaro Technologies Private Limited ("Liftkaro," "we," "us," or "our") collects, uses, and shares your information when you use our website (www.liftkaro.com / www.liftkaro.in / www.liftkaro.co.in), the "Liftkaro" customer mobile application, the "Liftkaro Partner App," and the B2B Client Web Portal (collectively, the "Platform"). This policy is a legally binding electronic record under the Information Technology Act, 2000. By using the Liftkaro Platform, you consent to the collection, storage, use, and disclosure of your information as described herein. This policy is incorporated into and subject to our Terms & Conditions. We may update this policy periodically. Your continued use of the Platform after any changes constitutes your unequivocal acceptance of the revised policy.

1Information We Collect

We collect information to provide, improve, and secure our services. This includes:

1.1. Information You Provide Directly

Account & Contact Information

Name, email address, mobile number, company name, and physical address when you register or contact us. For B2B Clients, this includes the details of authorized staff who access the Web Portal.

Booking & Operational Details

Comprehensive information for rental requests, including machine type, job scope, precise site location, site contact person, required dates, and any special instructions.

Payment Information

We use third-party payment gateways (e.g., RazorPay). While we do not store full card details, we retain transaction history, invoices, and necessary billing information for record-keeping and dispute resolution.

Partner KYC (Know Your Customer) Information

To ensure platform integrity, we collect verification documents from our Partners, including but not limited to:

  • Business registration documents, GSTIN, and PAN
  • Vehicle-specific documents (Registration Certificate, fitness certificate, insurance)
  • Operator details (driving license, certification)
  • Bank account details for processing payouts

Communications & Support Tickets

Records of your interactions with us, including the content of support tickets, email correspondence, feedback, and survey responses. For quality assurance and training, we may record customer support calls after obtaining your consent.

1.2. Information We Collect Automatically

Usage and Device Information

Details about your interaction with the Platform, including IP address, device type, browser, operating system, pages visited, and features used. This helps us improve user experience and security.

Location Information

We collect precise location data to enable core platform functionalities:

  • For Customers: To identify delivery locations and track the real-time position of your booked machine for ETA and operational oversight.
  • For Partners: To show your machine's availability to nearby customers, provide navigation to job sites, and enable live tracking for the customer during an active rental. Location is tracked when the Partner app is in the foreground and background during an active trip. This data is also used to verify trip start/end points for billing and dispute resolution.

In-App Messaging and Call Data

We collect data about communications between Customers and Partners that occur through our Platform's in-app messaging or calling features. This includes the date, time, and content of chats, which is used for safety, security, and to resolve disputes between users.

Cookies and Tracking Technologies

We use cookies to remember your preferences, personalize your experience, and analyze platform traffic. You can control cookie preferences through your browser settings, though disabling them may affect platform functionality.

Operational & Telematics Data

For machines equipped with telematics (GPS tracking devices), we may collect operational data such as engine hours, fuel levels, and fault codes to facilitate accurate billing, verify usage in case of disputes, and provide proactive maintenance alerts to Partners.

2How We Use Your Information

Your information is used for the following specific purposes:

To Provide Core Services

To operate the rental platform, process your bookings, facilitate payments, and manage your account.

To Provide Customer and Partner Support

We use account information, booking details, location data, payment history, and communication records (including support tickets and in-app chats) to investigate and resolve issues, answer questions, and provide technical and operational support to both Customers and Partners.

For Verification and Security

To verify user identities through our KYC process and to monitor, prevent, and detect fraudulent activities (such as GPS spoofing, false claims, or misuse of the platform), ensuring the security and integrity of the Platform.

For Billing and Financial Management

To generate invoices, process payments, and manage B2B client credit terms. We use operational data, location logs, and OTP records to verify trip durations and resolve billing disputes accurately.

To Enable Communication

To connect Customers and Partners for booking logistics. Our support teams may review these communication records to provide assistance or resolve disputes.

To Communicate With You

To send essential transactional communications (booking confirmations, invoices), service updates, and promotional offers. You can opt-out of marketing communications at any time.

For Analytics and Improvement

To analyze usage trends, conduct research, and continuously improve our platform's features, performance, and user interface.

For Legal and Compliance

To comply with applicable laws, regulations, and legal processes, and to enforce our Terms & Conditions and other agreements.

3How We Share Your Information

We share information only as necessary to operate the Platform. We do not sell your personal data.

Between Customers and Partners

  • We share with Partners: The Customer's name, company name, site address, contact number, and specific job requirements to enable them to fulfill the booking.
  • We share with Customers: The Partner's name, company name, machine details, operator name (if applicable), and the machine's real-time location during the rental period.

With Service Providers

We share information with third-party vendors who perform services on our behalf, such as payment processors, cloud hosting providers, and data analytics services. These providers are contractually obligated to protect your information and use it only for the purposes we specify.

With B2B Clients

Authorized users within a B2B client's organization can access data related to their own company's bookings, usage reports, and financial information via the secure Web Portal.

For Legal Reasons and Safety

We may disclose your information if required by law or in response to a valid request from a governmental or law enforcement agency. We may also share it if we believe it is necessary to protect the rights, property, or safety of Liftkaro, our users, or the public.

Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction under standard confidentiality agreements.

4Data Security and Retention

We implement robust physical, electronic, and managerial procedures to safeguard your information, including HTTPS encryption and AES-256 bit encryption for sensitive data.
You are responsible for maintaining the confidentiality of your account password. Do not share it with anyone.
We retain your personal information for as long as your account is active or as needed to provide you services. After account deletion, we will retain information necessary for legal, regulatory, tax, insurance, and audit purposes. Specifically, data related to financial transactions, contracts, and legal disputes may be retained for up to seven (7) years or as otherwise required by applicable Indian law to fulfill our compliance obligations and defend our legal interests.

5Your Choices and Rights

Access and Correction

You can access and update your profile information through your account settings. For corrections to information you cannot change yourself, please contact our support team.

Withdrawal of Consent

You may withdraw your consent for data processing by contacting us. Please note that this will likely result in the termination of your account and ability to use the Platform.

Opt-Out of Marketing

You can unsubscribe from promotional communications via the link in the message. You will still receive essential transactional and security-related messages.

Account Deletion

You may request the deletion of your account. Upon request, we will delete the information that we are not legally required to retain. We will retain data necessary for safety, security, fraud prevention, resolving disputes, enforcing our agreements, and for our legitimate business and legal compliance needs as detailed in the Data Retention section.

6Prohibited Activities and Use of Services

6.1. Prohibited Content (As per IT Rules, 2021)

As per Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you shall not host, display, upload, modify, publish, transmit, store, update or share any information that:

  • belongs to another person and to which the user does not have any right
  • is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force
  • is harmful to child
  • infringes any patent, trademark, copyright or other proprietary rights
  • violates any law for the time being in force
  • deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact
  • impersonates another person
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation
  • contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource
  • is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person

6.2. Prohibited Use of Rented Machinery

In addition to the content restrictions above, you are strictly prohibited from using any machinery rented through the Liftkaro Platform for the following purposes. The machines provided for rental include, but are not limited to, Construction & Earthmoving Equipment, Road Construction Equipment, Lifting & Material Handling Equipment, Concrete Equipment, Agricultural & Utility Equipment, Mining & Underground Equipment, Hauling & Transport Vehicles, and Industrial/Miscellaneous Equipment.

  • Illegal Activities: Using any machine for illegal mining, unauthorized demolition, transportation of illegal goods, or any other activity that violates local, state, or national laws.
  • Handling of Unauthorised Materials: Transporting or handling hazardous materials, explosives, toxic substances, or any other dangerous goods that were not explicitly declared and approved during the booking process.
  • Unsafe Operations: Operating a machine in a manner that is unsafe, reckless, or endangers the operator, other personnel, property, or the public. This includes exceeding the machine's specified load capacity, using it on unstable ground without proper precautions, or disregarding safety protocols.
  • Unauthorized Modifications or Operators: Modifying the machine in any way, or allowing any person who is not the certified operator provided by the Partner to operate the machinery.
  • Purpose Limitation: Using a machine for any purpose other than its intended design (e.g., using an excavator bucket for lifting personnel).

In case of non-compliance with these rules, this Policy, or our Terms & Conditions, we have the right to immediately terminate your access or usage rights to the Platform, remove non-compliant information, or both, and you may be held liable for any damages or losses incurred.

7Third-Party Links

Our Platform may contain links to other websites, products, or services that are not owned or controlled by Liftkaro. This Privacy Policy does not apply to such third-party services. We encourage you to review the privacy policies of any third-party websites you visit.

8Changes to This Privacy Policy

We reserve the right to update or amend this Privacy Policy at any time. Any changes will be effective immediately upon posting the updated policy on this page with a new "Effective Date." We will notify you of material changes by posting a prominent notice on our Platform or by sending you an email. Your continued use of our services after the effective date constitutes your acceptance of the revised policy.

9Governing Law and Dispute Resolution

This policy is governed by the laws of India. Any dispute arising from this policy shall be settled by binding arbitration in Gurgaon, Haryana, in accordance with the Arbitration and Conciliation Act, 1996.

10Grievance Officer

In accordance with the Information Technology Act, 2000, the Grievance Officer is the designated point of contact for any discrepancies or grievances you may have regarding the processing of your information under this policy.
